These Terms of Service ("Terms") govern your access to and use of the Outreach Platform and related services (the "Service"), operated by Joeckel Design of Green Bay, Wisconsin ("Joeckel Design," "we," "us"). By using the Service, creating an account, or authorizing us to run outreach on your behalf, you agree to these Terms. If you use the Service on behalf of a business, you represent that you are authorized to bind that business.

1. The Service

Outreach Platform is a done-for-you, managed outreach service. We source prospects in your market (or work from lists you provide), write and send outreach email on your behalf, and place outbound calls where your plan includes voice. Text-message outreach, social posting, and search content are available as add-ons; we set each up with you, and text messaging cannot begin until the carrier registration on your number is approved. Replies are forwarded to you; we do not negotiate or contract on your behalf.

2. Accounts & Eligibility

You must be at least 18 years old and use the Service for business purposes. Account access uses passwordless magic-link sign-in; you are responsible for keeping access to your email secure and for activity under your account. You agree to provide accurate information and to keep it current.

3. Plans, Billing & Cancellation

Plans are billed monthly in advance. The standard introductory rate is $29 for the first month. At our sole discretion we may offer an individual client a different introductory arrangement, including a free first month; where a free first month is offered it does not require a payment method, and the Service ends at the close of that month unless one is added. Introductory pricing is per client and is not an entitlement. Each following month renews automatically at the plan's regular rate until you cancel. Each plan includes a monthly usage allotment across channels; usage beyond the allotment is passed through at or near our cost and billed in arrears. You may upgrade, downgrade, or cancel on a month-to-month basis with notice as described at sign-up or in your service agreement; cancellation stops future renewals and takes effect at the end of the current billing period. Except where required by law, payments already made are non-refundable. Prices exclude applicable taxes. If a payment fails, we may suspend the Service until it is resolved.

4. Your Responsibilities & Acceptable Use

You are responsible for the offers, content, and contact data you approve or provide, and you warrant that:

  • You have a lawful basis and any required consent to contact the prospects we message on your behalf, including for email, calls, and texts;
  • Your outreach and offers comply with all applicable laws, including the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule, state telemarketing and messaging laws, and do-not-call requirements;
  • Your content is truthful and not deceptive, and does not promote illegal, harmful, harassing, adult, or otherwise prohibited goods or services;
  • You will not use the Service to send unsolicited bulk messaging in violation of law or carrier rules.

You are solely responsible for your content and for the lawfulness of contacting the recipients you target. We may refuse, pause, or remove any campaign or content, and suspend or terminate the Service, if we believe it violates these Terms, the law, or carrier or provider rules.

5. Messaging Compliance

We run outbound messaging on compliant infrastructure. Email carries a working unsubscribe link and your postal address in every message, and opt-outs are suppressed permanently. Voice campaigns run from a registered number, honour do-not-contact rules, and are placed only within the recipient’s local business hours — never outside 8am–9pm in their own time zone. We process opt-out and do-not-contact requests and retain them to enforce future suppression. These controls support, but do not replace, your own compliance obligations — you are responsible for having a lawful basis to contact the prospects we reach on your behalf.

6. No Guarantee of Results

Outreach outcomes depend on your market, offer, and many factors outside our control. We do not guarantee any specific number of leads, replies, meetings, sales, or revenue. Any plan, projection, or example we provide is a strategy preview, not a promise of results.

Performance figures we share are our own. Any metrics, response rates, or volumes we describe reflect campaigns Joeckel Design has run — for ourselves or for other clients — and are provided for context only. They are not a benchmark, forecast, or commitment for your account. Your market, offer, list quality, and follow-up will produce different results, and we make no representation that your results will resemble ours.

7. Deliverability

Whether a message reaches an inbox or a call connects is determined by third parties — mailbox providers, spam filters, and phone carriers — not by us. We follow accepted practices to protect deliverability, including gradual volume ramp-up, sender rotation, authenticated sending domains, and suppression of opt-outs and bounces. Even so, we cannot guarantee delivery, inbox placement, or that calls will not be labeled by a carrier. Filtering decisions, carrier labeling, and provider policy changes are outside our control.

8. Ramp-Up Period

New sending domains and phone numbers have no reputation history. Sending at full volume immediately causes lasting damage to deliverability, so we deliberately begin new accounts at reduced volume and increase over roughly the first four weeks. You acknowledge that activity and results during this ramp-up period will be lower than at full volume, and that ramp-up applies to each new sending identity added to your account.

9. Prospect Data & Exclusivity

Unless we agree otherwise in writing, prospect lists are not exclusive to you. We may source and contact the same businesses on behalf of other clients, including clients in your industry or market. Contact records we source remain part of our platform; contacts you provide remain yours, and we will not reuse a list you supply for another client. Replies and leads generated for your campaigns are yours.

10. Intellectual Property

We retain all rights in the Service, our software, workflows, and materials. You retain rights in your brand, content, and data. You grant us a limited license to use your brand, content, and provided data solely to operate and deliver the Service to you.

11. Confidentiality

Each party will protect the other's non-public information shared in connection with the Service and use it only to perform under these Terms.

12. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

13. Limitation of Liability

To the fullest extent permitted by law, Joeckel Design will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue. Our total liability arising out of or relating to the Service will not exceed the amounts you paid to us for the Service in the three (3) months before the event giving rise to the claim.

14. Indemnification

You will indemnify and hold harmless Joeckel Design from claims, damages, and costs (including reasonable attorneys' fees) arising from your content, your data, the recipients you target, or your breach of these Terms or of applicable law, including consent and messaging laws.

15. Suspension & Termination

We may suspend or terminate the Service for non-payment, violation of these Terms, or legal or carrier-compliance reasons. You may cancel as described in Section 3. On termination, your right to use the Service ends; provisions that by their nature should survive (including Sections 4, 6, 9–11) will survive.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the date above and, where appropriate, by notice. Continued use of the Service after changes take effect constitutes acceptance.

17. Governing Law

These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-laws rules. The exclusive venue for any dispute is the state or federal courts located in Brown County, Wisconsin, and you consent to their jurisdiction.
